Abstract: The paper presents a closer insight into the implications of the recently adopted data retention directive, especially its social and economic impacts. Both, however, expose some remaining open questions which the Directive obviously could not resolve and which could hinder the practical implementation of the Directives. The latter is mostly linked to the fast development of new communications, convergence of infrastructure, media and services but also competition issues. The case of Slovenia is used as an instructive example of data retentions legal evolution. A model for implementation of the Directive in the Slovenia case is also presented.
