Abstract: The article analyses the possibility of performance contracting (PC) as a concept for finance and service to encourage the rational use of energy, in order to reach the goal of a 25% carbon-dioxide reduction in Germany by 2005, compared to the 1987 situation. The focus in this article is on risk-sharing and the German legal framework in PC. An example will outline the general course of a contract and its practicability.
