Abstract: This paper analyses the nature and extent of protection offered by the Indian Information Technology Act, 2000 to e-commerce transactions and electronic data in India and makes a comparative analysis of the safe harbour principles of data privacy protection vis-a-vis the IT Act. Privacy of personal data and the rights of individuals flowing there from is one area which is not specifically safeguarded by the IT Act and calls for an urgent need to either amend the existing IT Act or to enact a comprehensive legislation offering adequate standard of protection for data privacy in India.
